If San Francisco-based cryptocurrency exchange, Coinbase, continues to allow fundraising through its platform for the Palestinian Islamic group Hamas and its military wing, the Qassam Brigades, they are likely to face a lawsuit by Israeli civil rights NGO Shurat HaDin (Israel Law Center).
The United States has classed Hamas as a terror group which would make any US citizen donating to their cause liable to face prosecution. Transactions with terrorist organizations were banned under the 1995 Counter Terrorism Act.
According to The Jerusalem Post, Shurat HaDin wrote to Coinbase saying: “It has recently come to our attention that the notorious Palestinian terrorist group Hamas currently maintains an account with Coinbase, Inc, through which it is accepting donations. Therefore we are writing to notify Coinbase that knowingly providing material support or resources to Hamas is a violation of US federal criminal law, and to demand that Coinbase immediately terminate any and all accounts and services provided to Hamas”.
The NGO Are No Strangers To Legal Action
Hamas has indeed contravened the Coinbase user agreement, specifically section 7.1. It reads: “Suspension, Termination, and Cancellation. We may: (a) refuse to complete or block, cancel or reverse a transaction you have authorised (b) suspend, restrict, or terminate your access to any or all of the Coinbase Services, and/or (c) deactivate or cancel your Coinbase Account with immediate effect for any reason, including but not limited to where…we suspect money laundering, terrorist financing, fraud, or any other financial crime”.
The NGO are no strangers to legal action and their mission is clear: “Shurat HaDin is at the forefront of fighting terrorism and safeguarding Jewish rights worldwide. We are dedicated to taking action to protect the State of Israel and its citizens”.Three years ago, they filed a suit against Facebook, accusing the social media giant of providing a platform for Hamas. They claimed that through the platform, the terrorist organization incited violence and murder against Jews.
